Thailand’s real estate market offers incredible lifestyle and commercial opportunities, but foreign buyers face strict statutory limitations regarding land ownership. Under the Thai Land Code, foreign individuals and foreign-registered corporations are generally prohibited from owning land freehold in their own names.

Exceptions to this rule are extremely rare and highly restricted—such as qualifying for specific Board of Investment (BOI) privileges or executing major capital investments (over 40 Million THB) in designated Thai government bonds. Legally Recognized Ownership Alternatives

While direct land ownership is restricted, Thai law provides several secure, fully recognized mechanisms that allow international investors to enjoy long-term property rights safely:

Condominium Freehold Ownership: The most straightforward option. Foreigners can hold 100% outright freehold title to a condominium unit, provided the total foreign ownership within the building does not exceed the statutory 49% foreign quota.

Registered Long-Term Leaseholds: Investors can enter into a 30-year lease agreement for land or villas. To be legally enforceable, leases over three years must be officially registered at the local Land Office, creating a legal burden on the title deed that protects your rights against third parties.

Property Rights (Usufruct & Superficies): Rights registered directly on the title deed—such as Superficies (ownership of structures on land) or Usufruct (right to possess and derive benefit from property)—provide strong legal protection and long-term security.
